These terms and conditions (the"Terms and Conditions") regulate the registration to and the activity of the incentives web (the"Website") of Liberty Seguros, Compañía de Seguros y Reaseguros, S.A. ("LibertySeguros"or"we"), a company registered in the Commercial Register of Madrid, Volume 29.777, Section 8a, Folio 2, Sheet M-377257. Its C.I.F. is A-48037642, and established in Madrid (28042), Paseo de las Doce Estrellas, 4. Its activity is supervised by the Directorate General of Insurance and Pension Funds, being registered in the Special Register of Insurance Entities with the key C-0467.

Object and conditions of access

These Terms and Conditions constitute the contract entered into between you and Liberty Seguros within the scope of the Website. In particular, they regulate your registration and use of the Website.

The Website is intended for Liberty Seguros customers who register as users in it, in order that they can request those incentives offered by Liberty Seguros in accordance with the established criteria, track your shipment or claim it, as well as Liberty Seguros mediators, who, on behalf of the users, perform the management (hereinafter both referred to as "Users" or “you"). It is essential to keep these Terms and Conditions the existence of at least one contract with Liberty Seguros.

Liberty Seguros' liability arising from these Terms and Conditions is limited only to the registration and use of the Site Users. The products and services provided by Liberty Seguros (the "Services") through the Website will be governed by the conditions relating to each relevant product or service.

These Terms and Conditions, together with our Data Protection Policy (and any additional terms of use that are incorporated and refer to the Terms and Conditions), regulate your use of the Website once you have registered with it, as well as our rights and obligations.

To use of the Website, acceptance of these Terms and Conditions is required during your registration. If you do not agree with the Terms and Conditions, you must refrain from registering on the Website, cancel your registration and/or refrain from using it.

Minors under the age of 18 will not be able to register and/or access the Website.

Registration procedure

Access to the Website and its subsequent use requires you to register and create an account by entering your personal data on the registration form (specifically, your VAT number and policy number, if you are a customer; and Agent Code and Password, if you are a mediator).

It is necessary to accept, both these Terms and Conditions, as well as the Data Protection Policy, in order to register as a User of the Website. Please note that any personal data you provide during the registration procedure and also through your use of the Website will be treated in accordance with the provisions of the Data Protection Policy.

Once the registration process is complete, the User will be assigned a username and password which will allow him/her to access www.regalos.libertyseguros.es. Usernames and passwords of the Website will be personal and non-transferable. It is therefore prohibited to transfer, even temporary, to third parties. The User undertakes to make diligent use of them and to keep them secret, at all times. In the event that the User knows or suspects the abduction, loss or unauthorized use of his/her username and password, please make such circumstance to our knowledge as soon as possible, through the following email address: controlesdeseguridad@libertyseguros.es. In the event of no such communication, Liberty Seguros shall not be liable as a result of improper operations.

Liberty Seguros reserves the right to cancel or restrict access to the Website with respect to certain Users, in case of observing any conduct that in Liberty Seguros' opinion is contrary to these Terms and Conditions, the applicable legislation at any time, or the rules established by Liberty Seguros. Likewise, Liberty Seguros may restrict access to the Website to certain Users for justified reasons related to the security mechanisms implemented in order to ensure the proper functioning of the Website and / or with the suspicion of an unauthorized or fraudulent use of the same.

Web Usage Rules

Liberty Seguros will do its best to, to the extent of its possibilities, ensure a good use of the Website. However, in the face of the impossibility of absolute and thorough control, Users will be solely responsible for their use of it.

The User undertakes to make diligent, appropriate and lawful use of the Website, in accordance with the applicable legislation at all times, morality and generally accepted good customs, public order and the provisions of these Terms and Conditions. The use of the Website by the User may never imply any kind of damage to it, its information and contents, nor for its operation or its development.

By interacting with the Website, the User undertakes not to provide any content:

• to the person who is aware that it is subject to confidentiality – except in those cases expressly authorized –is false, inaccurate, misleading or inaccurate;
• infringing any right of Liberty Seguros or other third parties, including but not limited to image or intellectual property rights;
• that constitutes a breach of any legal or regulatory rule or is prohibited for any other reason;
• containing malware (instructions capable of damaging computer or security systems, computers and the information they contain), worms or other potentially harmful computer programs or files.

The User shall be liable for damages of any kind that Liberty Seguros may suffer, directly or indirectly, as a result of the User's failure to comply with the obligations and rules of use contained in these Terms and Conditions.

Use of cookies

We use cookies or other storage devices to collect information about the use of the Website. THIS INFORMATION IS AVAILABLE IN THE COOKIES POLICY.

Technological limitations and maintenance

We inform the User that there are a wide variety of factors that, in certain cases, may affect the operation of the Website and/or its quality, such as, but not limited to: environmental conditions, network saturation, connectivity, third-party software, etc. Liberty Seguros reserves the right to discontinue the service of the Website at any time and without prior notice, provided that this is due to technical, security, control or maintenance reasons, supply failures, defects in telecommunications or any other reasoned cause.

Limitation of liability

Liberty Seguros is not responsible to the User, nor to third parties, for damages arising from incorrect use of the Website, or that are the result of the breach of these Terms and Conditions, the Data Protection Policy and/or the recommendations or instructions provided by Liberty Seguros.

The information regarding the products and services offered by Liberty Seguros on the Web is that provided by the service provider or the manufacturer of the good, without being considered responsible for the lack of accuracy of the same or for its lack of availability at all times, although it does its best to make it so.

Liberty Seguros also disclaims liability in the following cases: (i) technical failures that, for incidental or other reasons, prevent the normal functioning of the Website; ((ii) unavailability or continuity of the Website for maintenance or other reasons that prevent the availability of the same; and (iii) intrusions by third parties on the Website. Given the advances in the technique, it is impossible to completely prevent certain third parties from entering the Web and causing disturbances. Without prejudice to this, Liberty Seguros puts its best efforts, through the incorporation of the corresponding technological measures, to reduce this type of risk. However, the User is informed that these unlikely intrusions may occur and that Liberty Seguros will not be liable for any damages that maybe caused.

In addition, Liberty Seguros also cannot guarantee the absence of viruses or other elements in the contents of the Website that may cause alterations in the software or in the User's hardware, so it will not be responsible for damages and pergits of any nature that may arise from them.

Hyperlinks

The Website has hyperlinks with other websites that are not edited, controlled, maintained or supervised by Liberty Seguros, and aretherefore not responsible for the content of such websites. The content thereof is the responsibility of their respective owners, and Liberty Seguros does not guarantee or approve such content.

FOR THIS REASON PLEASE, BEFORE ACCESSING ANY THIRD PARTY WEBSITES OR LINKS, ALWAYS ACT WITH MAXIMUM DILIGENCE AND ALWAYS REVIEW THE TERMS AND CONDITIONS OF USE AND POLICIES OF SUCH WEBSITES.

Those Users who wish to establish hyperlinks to the Website must refrain from making false, inaccurate or incorrect statements about it or its content. In no case shall it be stated or implied that Liberty Seguros authorizes the hyperlink, or that it supervises, approves or assumes in any way the contents or services offered or made available on the website on which the hyperlink to the Website established. The establishment of the hyperlink does not imply in any case the existence of any relationship between Liberty Seguros and the owner of the website on which it is established. Termination and duration

These Terms and Conditions, as well as the rest of our applicable policies, will remain in force and will be binding from your registration on the Website until the end of the contractual relationship. In case of breach of these Terms and Conditions by the User, we may temporarily block your access to the Website. In the event that such non-compliance is serious or persistent (i.e., when it is not remedied within ten (10) days of its notification to the User), we may proceed to its cancellation as a user of the Website, without prejudice to the claim for the corresponding damages.

Jurisdiction and applicable law

Any controversy or conflict that may arise as a result of the use of the Website will be resolved in accordance with the legislation in force in Spain, subject to the jurisdiction and jurisdiction of the Courts and Tribunals of the domicile of the User, when it is located in Spain, or that of the Courts and Tribunals of Madrid, when it is outside Spain, expressly waiving any other jurisdiction or jurisdiction that may correspond in law.

If the User is not happy with the changes, he/she must stop using the Website. The use of the same after notification of the changes will imply acceptance of the same by the User.
